SUBMITTED BY: CHENOWETH, JACOB 0708 (2020-34032) (AR20-37852) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF WALMART, TO-WIT: BLUE IN COLOR MORPHIE POWER BOOST XL BATTERY CHARGER, BY TAKING POSSESSION OF MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM, A MERCHANT, OF THE POSSESSION, USE, BENEFIT OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $750.00, HAVING PREVIOUSLY BEEN CONVICTED OF A THEFT ON 10/09/2017, IN VIOLATION OF FLORIDA STATUTES 812.015, 812.014(1) AND 812.014(2)D; DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING, OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, METHAMPHETAMINE, SAID OBJECT BEING NEEDLE, IN VIOLATION OF FLORIDA STATUTES 893.145 AND 893.147; ON 031220, I WAS AT INVERNESS WALMART LOCATED AT 2461 EAST GULF TO LAKE HIGHWAY, INVERNESS, CITRUS COUNTY, FLORIDA WORKING A SPECIAL DETAIL TO COMBAT RETAIL THEFT. WHILE WORKING THIS DETAIL I WAS ADVISED BY LOSS PREVENTION OFFICER TRAVIS HAMPSHIRE WHO ADVISED THAT A MALE SUBJECT WEARING A GRAY IN COLOR SHIRT AND BLUE JEANS HAD REMOVED A BLUE IN COLOR BATTERY CHARGER AND CONCEALED IT ON HIS PERSONS. I WAS FURTHER ADVISED THAT THE BOX FROM THE CHARGER WAS LOCATED ON A SHELF EMPTY OF ITS CONTENTS. THE SUBJECT THEN EXITED THE STORE PASSING ALL POINTS OF SALE WHERE I MADE CONTACT WITH HIM. THE SUBJECT WAS IDENTIFIED A ZACHARY KELLNER (DEFENDANT). THE DEFENDANT WAS PLACED HIM HANDCUFFS. THE DEFENDANT WAS SEARCHED AND IN HIS FRONT RIGHT POCKET A SYRINGE WAS LOCATED. INSIDE THE DEFENDANTS WAIST BAND I LOCATED THE BLUE IN COLOR BATTERY CHARGER. THE DEFENDANT WAS ESCORTED TO THE LOSS PREVENTION OFFICE. POST MIRANDA THE DEFENDANT ADMITTED TO REMOVING THE BATTERY CHARGER AND CONCEALING IT BECAUSE HE NEEDED T CHARGE HIS CELL PHONE. THE DEFENDANT WAS ASKED ABOUT THE NEEDLE TO WHICH HE STATED THAT HE DIDNT THINK IT WAS USED. A CRIMINAL BACKGROUND OF THE DEFENDANT REVEALED THAT HE HAD A PREVIOUS RETAIL THEFT CONVICTION ON 10/09/2017. THE DEFENDANT WAS ADVISED THAT HE WAS UNDER ARREST FOR RETAIL THEFT SECOND OFFENCE AND DRUG PARAPHERNALIA. A FIELD TEST WAS COMPLETED ON THE SYRINGE WHICH TESTED POSITIVE FOR METHAMPHETAMINE. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY JAIL BY DEPUTY MERRITT. PRIOR TO LEAVING THE SCENE A SWORN STATEMENT WAS COMPLETED BY THE COMPLAINANT AND THIS DETECTIVE OBTAINED A COPY OF THE VIDEO FOOTAGE. THE DEFENDANT IS CHARGED WITH ONE COUNT OF RETAIL THEFT (2ND OFFENCE) WITH A BOND OF $1,000.00 AND ONE COUNT OF POSSESSION OF PARAPHERNALIA WITH A BOND OF $1,000.00 THE DEFENDANTS TOTAL BOND IS $2,000.00 PER THE BOND SCHEDULE.

All vehicles must be completely secured while on Citrus County Detention Facility property. Will I be searched? All visitors and their possessions entering the Citrus County Detention Facility are subject to search. The visitor may be required to submit to an electronic or pat search before entry is permitted. What is the dress code for visitation? Visitors are required to wear long pants (or a dress/skirt/shorts of appropriate length), shirts, underclothes and shoes. No low cut blouses. All shirts/blouses must have sleeves. No jackets or sweaters may be used to cover a sleeveless shirt/blouse. Shorts/Skirts must reach at least to the top of the knee. No bathing suits, halter tops, tank tops, tube tops, muscle shirts or miniskirts are allowed. The Visitation Officer will determine if clothing is appropriate. What type of identification do I need to be allowed into the facility? Each visitor must produce a driver’s license, state issued photo identification or passport upon entering the facility. What items am I allowed to bring to visitation? Cell phones, cameras, cigarettes, lighters, knives, guns, and handcuff keys, are not allowed to be brought into the facility. Only photo identification and car keys will be allowed into the visitation area. No purses, wallets, bags, brief cases, etc. will be allowed into the visitation area. We recommend leaving these items in your secured vehicle. The facility has storage space for umbrellas in case of inclement weather. For those unable to store their personal items in a secured vehicle, there are a limited number of lockers available in the lobby. Items not allowed in the facility will not be stored in these lockers. The facility is not responsible for items brought into the facility that are not allowed into the visitation area.
